Welcome to Devianops (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our SaaS platform, QUALI-D (“Service”), provided by Devianops. By using our Service, you agree to be bound by these Terms.

1. Service Description

QUALI-D is a subscription-based service that allows users to analyze recorded calls and WhatsApp Business API conversations for performance analysis in sales and customer support. Users purchase credits, which are used to analyze their recordings and conversations.

2. Account Registration

To use our Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to keep your account information updated.

3. Payments and Credits

Users must purchase credits to analyze recorded calls and WhatsApp conversations. Payments are processed securely through our payment partners. Credits are non-refundable and non-transferable. The credits purchased will be deducted from your account when you request an analysis.

4. Data Storage and Privacy

• Recorded Calls: We do not store any recorded calls. We only store the transcriptions of the calls and the analysis results generated by our Service.

• WhatsApp Conversations: We store WhatsApp conversations. These conversations are securely stored and used for analysis and performance evaluation.

5. WhatsApp Business API Integration

We offer integration with the WhatsApp Business API to analyze conversations. By using this feature, you agree to comply with all applicable WhatsApp policies. The content of these conversations is stored and analyzed by our Service.

6. User Obligations

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to violate any applicable laws or regulations, or to infringe on the rights of others.

7. Intellectual Property

All content, features, and functionality available on the QUALI-D platform are the exclusive property of Devianops and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service as permitted by these Terms.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, if you violate these Terms or if we believe your actions may harm the Service or other users.

9. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service will be uninterrupted, secure, or free from errors. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

In no event shall Devianops, its directors, employees, or affiliates be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Service, even if advised of the possibility of such damages.

11. Changes to the Terms

We may update these Terms from time to time. When we make changes, we will notify you by updating the “Last Updated” date at the top of these Terms. Your continued use of the Service after any changes indicates your acceptance of the new Terms.
